MARVELLISS IWEAR, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS
STATED HEREIN.
1. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL
MARVELLISS IWEAR, ITS AFFILIATES, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY
DAMAGES BEYOND THE ACTUAL DOLLAR AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC ORDER IN QUESTION.
BY PURCHASING FROM THIS SITE, ALL CUSTOMERS
AGREE AND ADHERE TO THIS POLICY, EXPRESSLY WAIVING THE RIGHT TO PURSUE
LEGAL ACTION, CLASS ACTION SUITS, OR CLAIMS FOR DAMAGES EXCEEDING THE
PURCHASE PRICE OF THEIR PRODUCT.
2. HEALTH AND MEDICAL DISCLAIMER
All frames sold by Marvelliss iWear are not a Replacement for Eye Exams: All eyewear sold by Marvelliss iWear (including fashion frames, sunglasses, and non-prescription glasses and sunglasses) is strictly non-prescription and non-medicated. These
products are not intended to replace professional medical advice, diagnosis, or routine eye examinations by a licensed optometrist or ophthalmologist.
Non-Medical Device Status: Our products are not medical devices. They are not intended to treat, cure, mitigate, or prevent any eye disease, condition, or visual impairment.
3. USAGE AND SAFETY WARNINGS
Direct Sunlight Warning: NEVER look directly at the sun or a solar eclipse while wearing these glasses.
Our lenses are not designed for solar observation.
Driving Restriction: Use caution when wearing specialized tints or blue light filters.
Dark sunglasses should never be worn while driving at night. Some filters may alter visual acuity; if your vision is impaired or altered, do not operate a vehicle or heavy machinery.
Impact Resistance & Hazards: While our lenses meet FDA impact resistance requirements (21 CFR
801.410), they are NOT SHATTERPROOF. These glasses are not intended for use as industrial safety eyewear, nor do they provide protection against artificial high-intensity light sources such as sun lamps or lasers.
4. WARRANTIES AND RISK
"As-Is" Provision: All products are provided on a new "as-is" and "as available" basis. Marvelliss iWear disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
Assumption of Risk: The user assumes all risks associated with the use of the product. Marvelliss iWear is not responsible for any injury or damage resulting from the misuse or normal wear and tear of the frames or lenses.
5. GOVERNING LAW AND JURISDICTION
This disclaimer and all transactions conducted through Marvelliss iWear shall be governed by and construed in accordance with the laws of The State of Arizona, without regard to its conflict of law principles. Any legal
proceedings arising from your purchase must be brought exclusively in the courts located within Arizona.
6. INTELLECTUAL PROPERTY
All content included on the Marvelliss iWear website, including but not limited to text, graphics, logos, images, and digital downloads, is the property of Marvelliss iWear and is protected by United States and international copyright laws.
